TOUR OPERATOR REWARDS PROGRAM
Rules & Regulations
- HOW TO ENTER: To become an entrant (“Entrant”) in the Tourism Kelowna Operator Incentive Promotion (the “Promotion”), visit www.tourismkelowna.com/rewards and fill out the online entry form.
- SPONSOR: Tourism Kelowna is the sole Promotion sponsor (the “Sponsor”).
- ENTRY GUIDELINES: To be eligible to win, an Entrant must be the age of majority or older in their respective Province, State, Region and/or Country. Promotion is open to Group Tour / FIT Operators, Group Travel Leaders, Bank Travel Clubs and/or Receptive Operators. Sponsor’s employees and their parents, siblings and children, and persons domiciled with an employee of the Sponsor, their agents, parent, affiliated or related companies, subsidiaries, divisions, and promotional and advertising agencies and administrators, are ineligible to win.
- PROMOTION PERIOD: The Promotion starts at 12:01 a.m. Pacific Time (“PT”) on March 1, 2006 and closes on December 31, 2007 at 11:59 p.m. PT (the “Promotion Period”)
- PROMOTION: During the Promotion Period, the number of paid two-night hotel rooms utilized will be compared to the number of the paid two-night hotel rooms utilized from 12:01 a.m. Pacific Time (“PT”) March 2, 2004 to 11:59 p.m. PT December 29, 2005. The Entrant with the greatest percent increase of paid two-night hotel rooms utilized will win the grand prize.
“Paid two-night hotel rooms utilized” means a hotel room must be booked by the entrant and then occupied by the guest on whose behalf the entrant made the booking on the date specified by the original booking for two consecutive nights. Hotel bookings that are non-consecutive, cancelled by any party or are unused by the guest for any reason do not qualify.
In the event of a tie, the winner will be selected amongst all tying Entrants via random draw. Only tying Entrants will be included in the draw.
Tours must be booked and completed within the Promotion Period to be eligible for the Promotion.
A total of seven (7) random draws will take place during the Promotion Period amongst all Entrants to determine secondary prize winners.
All bookings must be made under the booking code TKO0607.
- PRIZE DETAILS: There is one (1) grand prize (the “Grand Prize”) of Five Thousand Dollars ($5,000.00 USD). There are seven (7) secondary prizes of Two Hundred Dollars ($200USD) each (each a “Secondary Prize”). All the eligible entries received during the Promotion Period will qualify for the Grand Prize and the Secondary Prize(s). No purchase necessary. Void where prohibited.
The Grand Prize and the Secondary Prize(s) must be accepted as awarded. The Grand Prize and SecondaryPrize(s) may not be transferred. The Sponsor reserves the right to substitute any Prize(s) in whole or in part in the event that all or any component of any Prize(s) is/are unavailable.
- PRIZE AWARDING: A total of seven (7) random draws will take place at Tourism Kelowna (544 Harvey Avenue, Kelowna, BC, V1Y 6C9) from among all Entrants. The first Entrant name drawn at each draw will be eligible to win a Secondary Prize (a “Potential Winner”). The odds of winning a Secondary Prize will depend upon the total number of Entrant names received during the Promotion Period.
These draws will take place on or around: September 4, 2006; December 4, 2006; February 7, 2007; April 11, 2007; June 6, 2007; August 8, 2007 and; October 8, 2007.
On or about December 31, 2007 all eligible entries will be tallied by Tourism Kelowna. The Entrant with the greatest percentage increase of paid two-night hotel rooms utilized will be awarded the Grand Prize (a “Potential Winner”).
- POTENTIAL WINNERS: Tourism Kelowna, acting reasonably, will attempt to contact a Potential Winner by telephone within seven (7) business days after the tally or draw as the case may be. In the event a Potential Winner cannot be contacted within 7 business days after the tally or draw, he or she will be disqualified. For the Grand Prize, the Entrant with the second highest percentage increase of paid two-night hotel rooms utilized will be awarded the Grand Prize in the event that the first Potential Winner is disqualified.
Proof of identification must be provided upon request. In order to be declared a winner, a Potential Winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by Tourism Kelowna. Before being awarded the Grand Prize or a Secondary Prize, a Potential Winner will be required to sign and return within the time stipulated by the Sponsor, a full release and indemnity form stating that he/she has read and understood these official rules and regulations (“Rules”); that he/she grants all consents required; that he/she authorizes the Sponsor to broadcast, publish and disseminate his/her name, address, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the Potential Winner beyond the awarding of or participation in the Prize; that he/she accepts the Prize as offered and releases the Sponsor from any and all liability of any kind arising out of the Potential Winner’s participation in this Promotion and receipt and use of the Prize. In the event that the Potential Winner does not comply with all the provisions as contemplated in these Rules, Sponsor shall have the right to disqualify a Potential Winner and draw an alternate Potential Winner and the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a Potential Winner shall be applied, with the necessary amendments, until a qualified winner has been duly selected.
- ACCEPTANCE OF TERMS: By entering the Promotion, each Entrant automatically agrees to accept and abide by these Rules. All decisions of the Sponsor with respect to any aspect of the Promotion, including without limitation the eligibility of entries, are final and binding on all Entrants in all matters as they relate to the Promotion.
- GENERAL CONDITIONS: All entries become the property of Sponsor who assumes no responsibility for garbled, lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with Entrants requesting Rules by mail or requesting names of Grand Prize and Secondary Prize winner(s) (for which a self-addressed, postage paid envelope must be included). Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void. If for any reason, in the opinion of the Sponsor, in its sole discretion, the Promotion is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Promotion is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Sponsor reserves the right to cancel, terminate, modify, amend, extend or suspend the Promotion including canceling any method of entry, and select a winner from previously received eligible entries. Sponsor reserves the right to modify the Rules without materially affecting the terms and conditions hereof. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage any web site or to undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent of the law. Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Promotion including any damage to an Entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in the Promotion or from downloading any material from the Promotion web site, where applicable.
- LAWS: Promotion is subject to all applicable federal, provincial and municipal laws and regulations. By entering the Promotion, each Entrant consents to the collection, use and distribution of his/her personal information (information that identifies an Entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling this Promotion. Sponsor will not sell or transmit this information to third parties except for the purposes of administering this Promotion. Any inquiry concerning the personal information held by the Sponsor should be addressed to Tourism Kelowna, 544 Harvey Avenue, Kelowna, BC, V1Y 6C9.
